An Expired Execution Can't Be Re-Issued In A Summary Process (Eviction) Case

An expired execution can't be re-issued in a Summary Process case, the Appeals Court decided. SeeFort Point Investments, LLC v. Kirunge-Smith, et al.,

Note: This happens quite a bit. Sometimes the landlord is still working with the tenant after getting the Execution and isn't really paying attention to the date on the Execution. For example, I work with a lot of conservatorships who, after they get an execution, will continue to work amiably with the tenant who is usually a long time resident of the property. Be careful.
